Constitution
ARTICLE I. NAME
This organization shall be called the Student Council of Pekin Community High School.
ARTICLE II. OBJECTIVES
The objectives of the Student Council of Pekin Community High School shall be the following:
1. To foster and promote the best interests of the school; 2. To develop more interest in the activities and accomplishments of the school; 3. To promote and enhance student relations; 4. To maintain any services as they rise for the benefit of the school body; 5. To foster and develop new ideas for the student body; 6. To address and discuss student issues, ideas, and concerns to the appropriate level of administration; 7. To promote and enhance relations between the school and the community; and 8. To work harmoniously with the administration, faculty, staff, and the school board.
ARTICLE III. AUTHORITY
All power and authority of the Student Council shall be given to it by the administration. The administration will have the right to review and veto any Student Council activity.
ARTICLE IV. ORGANIZATION
Section 1: The Student Council shall consist of the following members:
1. An executive board 2. Ten representatives per sophomore, junior, and senior class per semester 3. Eleven freshmen per semester 4. Faculty Advisors
Section 2: The Executive Board shall consist of the following members:
1. President 2. First Vice-President 3. Second Vice-President 4. Treasurer 5. Secretary 6. Historian 7. Historian-Elect 8. Parliamentarian 9. All District Officers 10. All State Officers
Section 3: Additional Executive Board members may be appointed as ex-officio members by a secret ballot vote in an Executive Board Meeting. Ex-officios must not hold any other Executive Board position and will be a non-voting member.
Section 4: The formation of standing and ad-hoc committees should be approved by the Student Council General Assembly by a majority vote.
Section 5: If there is a vacancy in any of the offices elected, the Election Board shall conduct elections as normal. All candidates should continue to run for the office for which they initially petitioned, and no adjustments should take place preceding the election. After the election, the elected officers should adjust the duties of the Executive Board.
Section 6: The rules for vacancies are as follows:
A. In the event of a vacancy of the office of President, the First Vice-President shall be named Acting President, and assume the constitutional duties of the combined offices of President and First Vice-President. B. In the event of a vacancy in the office of First Vice-President, the Second Vice-President shall be named Vice President, and assume the constitutional duties of the combined offices of First Vice-President and Second Vice-President. C. In the event of a vacancy in the office of Second Vice-President, the office will remain vacant, and the First Vice-President will assume the constitutional duties of the combined offices of First Vice-President and Second Vice-President. D. In the event of a vacancy in the office of Treasurer or Secretary, the Executive Board shall appoint a duly qualified member of Student Council to assume the constitutional duties of the respective office. E. In the event of a vacancy in the office of Historian, the current Historian-Elect shall assume the constitutional duties of the combined offices of Historian and Historian-Elect. The officer shall finish the term as appointed, but may request the appointment of an additional officer. F. In the event of a vacancy in the office of Historian-Elect or Parliamentarian, then the appointment of a new officer shall be in compliance with the election procedure for each respective office.
ARTICLE V. REQUIREMENTS FOR CANDIDACY OF REPRESENTATIVES
Section 1: All representatives must have received at least a 2.0 average in 4 major subjects for the semester preceding elections, also the semester preceding the term to be served.
Section 2: No person may be elected more that one term each school year. A term served through appointment by the Executive Board shall not be classified as a term served through election.
ARTICLE VI ELECTION OF REPRESENTATIVES
Section 1: All election procedures shall be determined by the Election Board.
Section 2: All Student Council Representatives for both Semesters shall be elected in the spring of the previous year. Seven candidates per semester shall be elected by the student body from each class. Three candidates from each class per semester shall be appointed by the Executive Board by a secret ballot. Both semester freshmen will be elected in a procedure where their various feeder junior high schools elect eighth graders in the spring to be representatives the following semester. The numbers are as follows: Edison-3, Broadmoor-3, Georgetowne-2, South Pekin-1, Rankin-1, and St. Joseph-1, per semester.
ARTICLE VII DUTIES OF THE REPRESENTATIVES
The duties of the Representatives shall be to obtain and recognize opinions of their fellow class members and to present them to the Student Council, to perform any special duties required of them to the Student Council, and to cast their votes in Student Council matters. ARTICLE VIII REQUIREMENTS FOR CANDIDACY OF OFFICERS
Section 1: A candidate for the office of President must be carrying four major subjects. The candidate must be a junior, received a 2.0 average in four major subjects for the semester and the nine weeks preceding the election, and must receive a 2.0 nine week average during the term. A candidate shall be eligible for the position of President in two different ways: A. The candidate has at least one semester as representative on Student Council, and at least one full year on Executive Board prior to taking office. B. The candidate has served as a representative on Student Council for three consecutive years, and must have approval from the advisors.
Section 2: A candidate running for the office of First Vice-President must be a sophomore or a junior and must have served one semester of Student Council prior to taking office. The candidate must have received at least 2.0 average in four major subjects for the semester and the nine weeks preceding the election, and must receive a 2.0 nine week average during the term.
Section 3: A candidate running for the office of Second Vice-President must be a freshman and must have served one semester of Student Council prior to taking office. Candidates must have received at least 2.0 average in four major subjects for the semester and the nine weeks preceding the election, and must receive a 2.0 nine week average during the term.
Section 4: A candidate running for the office of Treasurer must be a sophomore or a junior and must have served one semester of Student Council prior to taking office. Candidates must have received at least 2.0 average in four major subjects for the semester and the nine weeks preceding the election, and must receive a 2.0 nine week average during the term.
Section 5: A candidate running for the office of Secretary must be a sophomore or a junior and must have served one semester of Student Council prior to taking office. Candidates must have received at least 2.0 average in four major subjects for the semester and the nine weeks preceding the election, and must receive a 2.0 nine week average during the term.
Section 6: A candidate seeking the office of Historian-Elect must be a freshman or sophomore, must have served one semester of Student Council prior to taking office. Candidates must have received at least 2.0 average in four major subjects for the semester and the nine weeks preceding the election, and must receive a 2.0 nine week average during the term.
Section 7: A candidate seeking the office of Parliamentarian must have served one semester on Student Council prior to taking office. Candidates must have received at least 2.0 average in four major subjects for the semester and the nine weeks preceding the election, and must receive a 2.0 nine week average during the term.
ARTICLE IX ELECTION OF OFFICERS
Section 1: All election procedures shall be determined by the Election Board as a whole. The Election Board shall consist of the advisors, and any members of the Executive Board that are not seeking election. The chairperson of the Election Board shall be the highest ranking elected officer, and the co-chairperson shall be the highest ranking non-elected officer. All decisions of this board must pass a two-thirds vote. Before each election the Election Board shall publish the official election procedures to be used during the elections. Any rules stated in the election procedures that conflict with the Student Council Constitution of Pekin Community High School should be considered null and void.
Section 2: The President shall be elected by the entire student body for a two semester term at a time designated by the Election Board.
Section 3: The First Vice-President shall be elected by the present sophomore and junior classes for a two semester term at a time designated by the Election Board.
Section 4: The Second Vice-President shall be elected by the present freshman class for a two semester term at a time designated by the Election Board.
Section 5: The Treasurer shall be elected by the entire student body for a two semester term at a time designated by the Election Board.
Section 6: The Secretary shall be elected by the entire student body for a two semester term at a time designated by the Election Board.
Section 7: The Historian-Elect shall be appointed by the Advisors and the present Historian and Historian-Elect. He/She will serve the second year as Historian.
Section 8: The Parliamentarian shall be elected by the Student Council for a two semester term at a time designated by the Election Board.
Section 9: The Executive Board shall be sworn in with an oath of office to be administered by the outgoing officer and administrative representative present.
ARTICLE X DUTIES OF OFFICERS
Section 1: The duties of President shall be to preside over meetings of the Student Council, chair the Executive Board, and act as a liaison between the Administration and the student body.
Section 2: The duties of First Vice-President shall be to assist the President, to perform any other duty delegated by the administration and the Executive Board, and shall chair the constitution committee.
Section 3: The duties of Second Vice-President shall be to assist the President, to perform any other duty delegated by the Administration and the Executive Board, and shall be a member on the constitution committee.
Section 4: The duties of Treasurer shall be to keep records of Student Council funds, pay bills, and make a report when requested upon, and take on any other duty delegated by the Administration and Executive Board.
Section 5: The duties of Secretary shall be to keep record of proceedings at meetings of the council, and shall make a report of such correspondence to the Student Council at the next Student Council meeting, and take on any other duty delegated by the Administration and Executive Board.
Section 6: The duties of Historian shall be to organize and assemble the Honor Council Book, compile an evaluation of all Student Council activities, and take on any other duty delegated by the Administration and Executive Board.
Section 7: The duties of Historian-Elect shall be to help the Historian gather and assemble the Honor Council Book and organize a scrapbook of Student Council activities. He/She will also co-chair the Honor Council Committee, and take on any other duty delegated by the Administration and Executive Board.
Section 8: The duties of Parliamentarian shall be to advise the Student Council on the Constitution of Pekin Community High School, on our parliamentary procedure, co-chair the Constitution Committee, and take on any other duty delegated by the Administration and Executive Board.
ARTICLE XI DUTIES OF ADVISORS
The role of advisor is to guide and facilitate the actions of the Student Council. The role of an advisor is also to follow the duties as stated in the contract granted to them by the administration.
ARTICLE XII MEETINGS
Section 1: The Student Council shall meet at a time designated by the Administration and the Advisors.
Section 2: Meetings of standing committees and of any additional committees shall be held at a time designated by the chairperson of that committee
A. Honor Council Committee shall consist of the Chairperson (Historian), Co-chair (Historian-Elect), and council members appointed by the Executive Board at the beginning of each semester upon the request of the Chairperson.
B. Publicity Committee shall consist of council members appointed by the Executive Board at the beginning of the semester.
C. Constitution Committee shall consist of Chairperson (First Vice-President), Co-chair (Parliamentarian), and council members appointed by the Executive Board upon request.
D. The appointment of additional committees to perform various duties for the Student Council shall be determined by the entire Executive Board.
Section 3: Student Council shall adopt a set of rules in which the meetings shall be conducted. In order to carry on business, the Council must have a quorum of twenty-four members present and a minimum of one advisor present.
ARTICLE XIII IMPEACHMENT AND REMOVAL
Section 1: Any officer of the Student Council may be impeached by the following:
A. A petition seeking impeachment, of twenty-five percent of the student body for which the officer serves.
B. Removal of the office shall be two- thirds vote of those voting in favor of conviction by the student body for which the officer serves.
Section 2: The Administration has the right to remove any officer whom they deem necessary.
Section 3: Any representative may be removed by all of the following:
A. By the Faculty Advisors
B. By two-thirds vote in favor of removal by the Student Council
C. At the beginning of each year, the Executive Board shall construct a discipline policy in compliance with the Pekin Community High School activity code.
Section 4: The Administration always has the right to remove any representative they deem necessary.
Section 5: All Officers’ and Representatives’ grades are to be checked weekly to be certain they are passing four major subjects. Anyone found to not be in compliance with the above will be removed from the council to their regularly scheduled class until the deficiency has been corrected.
Section 6: Should a Representative not be passing four major subjects at the end of the semester, he/she will be ineligible to serve for the following semester. (In compliance with the Activity Code.)
Section 7: Should an Officer not be passing four major subjects at the end of the semester, he/she will be removed and replaced by an appointment by the Executive Board.
ARTICLE XIV APPROPRIATIONS OF FUNDS
Section 1: Prices for school activities must be presented to the entire Student Council General Assembly and pass a majority vote.
Section 2: A person seeking reimbursement must present the Treasurer with a detailed account of funds with receipts.
Section 3: Major expenses and gifts for the council as a whole are recommended to be approved by the Student Council General Assembly by a majority vote.
ARTICLE XV RATIFICATION AND AMMENDMENTS
Section 1: This Constitution shall be ratified by a two-thirds majority vote of the Student Council. After the proposed Constitution is presented to the Student Council it must be acted upon no sooner than one week and no sooner that three weeks after presentation.
Section 2: Amendments to the Constitution may be presented to the Student Council by the proponent of the amendment. In order to be accepted, the amendment must be approved by a two-thirds vote no sooner than one week and no later that three weeks after it is proposed.
Section 3: If at any point in time there is a discrepancy in the interpretation of any part of the Student Council Constitution of Pekin Community High School (excluding rules regarding elections), then the Constitutional Interpretation Committee shall be formed. The Constitutional Interpretation Committee shall consist of two advisors, the First Vice-President, the Parliamentarian, and three Representatives elected to the committee by the Student Council General Assembly. No advisor, Officer, or Representative shall be placed on the Constitution Interpretation Committee if the discrepancy is regarding a question which involves that person. The Constitution Interpretation Committee shall not be allowed to make any amendments to the constitution without following the standard amendment procedures outlined in Article XV Section 2. |
